The terms governing the use of the DHS Africa website and services.

These Terms of Use govern your access to and use of the DHS Africa website (dhs.africa) and any content, forms, or features made available through it. By accessing the site you agree to these terms. If you do not agree, please do not use the site.

Throughout these terms, “we”, “us”, “our”, and “DHS Africa” refer to DH Solutions Africa UG. “You” or “your” refers to the person accessing the site.

2. Scope

These terms apply to the public website. They do not cover the contracts, statements of work, data processing agreements, or licence terms that govern any project we deliver to a client. Those engagements are governed by their own separate written agreements.

3. Use of the site

You may use the site to:

  • Read information about DHS Africa, our work, and the kinds of digital healthcare technology we build.
  • Submit a message through the contact or demo form to start a conversation.
  • Follow links to public resources we reference.

You agree not to:

  • Use the site for any unlawful purpose, or in any way that infringes the rights of others.

You are granted a limited, revocable, non-exclusive, non-transferable licence to access and view the site for your own personal or internal business use. You may share short quotes or links to specific pages with proper attribution. Any other use — including copying, modifying, distributing, publishing, selling, or framing whole pages or sections — requires our prior written permission.

5. Submissions through forms

When you send us information through a contact, demo, or project form, you confirm that the information is yours to share and that submitting it does not violate the rights of any third party.

You grant us a non-exclusive, royalty-free, worldwide licence to use, store, and process the information you submit for the purpose of replying to you and following up about the project, demo, or partnership you wrote in about. We do not claim ownership of your submission. We handle submissions in accordance with our Privacy Policy.

The site may link to third-party websites — for example, partner organisations, public references, regulatory bodies, or external resources. We do not operate or control those sites and are not responsible for their content, security, availability, or privacy practices. Following an external link is at your own discretion and risk.

References to third-party products, services, or organisations on this site are descriptive only and do not imply endorsement, sponsorship, affiliation, or partnership unless explicitly stated.

The DHS Africa website is informational. Nothing on the site is, or is intended to be, medical, clinical, legal, regulatory, financial, or other professional advice. 8. Disclaimers of warranty

To the maximum extent permitted by applicable law, the site is provided “as is” and “as available”, without warranties of any kind, either express or implied. Without limitation, we do not warrant that:

  • The information presented on the site is complete, accurate, up to date, or fit for any particular purpose.

  • Files made available through the site are free of viruses or harmful components.

Statutory warranties that cannot be excluded under mandatory law are not affected by this clause.

9. Limitation of liability

To the extent permitted by applicable law, DH Solutions Africa UG, its directors, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, revenue, data, business, or goodwill, arising out of or in connection with your access to or use of the site.

Our aggregate liability for any claim arising out of or in connection with the site — regardless of legal basis — will not exceed the greater of one hundred euros (EUR 100) or the amount you have paid us in the twelve months preceding the event giving rise to the claim.

The above limitations do not apply to liability for intent or gross negligence, for injury to life, body, or health, for fraudulent misrepresentation, for liability under the German Product Liability Act (Produkthaftungsgesetz), or where liability cannot be excluded or limited under mandatory law.

10. Indemnification

You agree to defend, indemnify, and hold harmless DH Solutions Africa UG and its employees, contractors, and licensors from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of (a) your misuse of the site, (b) your breach of these terms, or (c) your violation of any law or the rights of a third party in connection with the site.

11. Suspension and changes to the site

We may, at any time and without notice, modify, suspend, or discontinue the site or any part of it. We may also restrict access to specific pages or features. We are not liable to you or any third party for any modification, suspension, or discontinuation of the site.

The date at the top reflects the most recent revision. Material changes will be brought to your attention through a notice on the site or, where appropriate, directly. 13. Governing law and jurisdiction

These terms, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and excluding the conflict-of-laws rules.

The exclusive place of jurisdiction for all disputes arising out of or in connection with these terms is Munich, Germany, to the extent permitted by mandatory law. We retain the right to bring legal action against you at your general place of jurisdiction. Mandatory consumer-protection rights of users domiciled in the EU remain unaffected.

14. Severability and entire agreement

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions remain in full force. The parties will replace the invalid provision with a valid one that comes closest to the economic intent of the original. These terms, together with the Privacy Policy and Cookie Policy referenced in them, form the entire agreement between you and DH Solutions Africa UG regarding the use of the site.
